ORDINANCE NO. #220

AN ORDINANCE TO AMEND ORDINANCE NO. 187 BEING AN ORDINANCE ESTABLISHING A DOWNTOWN DEVELOPMENT AUTHORITY WITHIN THE VILLAGE OF THREE OAKS, BERRIEN COUNTY, MICHIGAN

THE VILLAGE OF THREE OAKS ORDAINS:

Section 1. Section 3., ESTABLISHMENT OF GOVERNING BOARD, of Ordinance No. 187, is hereby amended to read as follows:

Section 3. ESTABLISHMENT OF GOVERNING BOARD

The said Authority shall be under the supervision and control of a Board, consisting of the President of the Village of Three Oaks or the President’s designee from the Village Council and 8 members appointed by the said President of the Village of Three Oaks; subject to the approval of the Village Council of the Village of Three Oaks. A majority of the members shall be persons having an interest in property located in the downtown district or officers, members, trustees, principals, or employees of a legal entity having an interest in property located in the downtown district. One of the members shall be a resident of the district, if the district is found to have 100 or more persons residing therein. Of the first members appointed as equal a number as practicable shall be appointed for one year, two years, three years and four years. A member of the Board shall hold office until the member’s successor is appointed. Thereafter each member of the Board shall serve for a term of four (4) years. Members of the Board shall serve without compensation, but they shall be reimbursed for actual and necessary expenses. The Chairperson of the Board shall be elected by the Board.

Section 2. All ordinances, resolutions, or parts thereof in conflict with this ordinance are hereby repealed.

Section 3. This ordinance was enacted by the Village Council of the Village of Three Oaks at a regular meeting held virtually via “Zoom” on the 10th day of March , 2021, and published in The Herald-Palladium, or another newspaper of general circulation within the boundaries of the Village of Three Oaks, on the 20th day of March , 2021, and ordered to be effective upon publication. All ordinances or parts of ordinances in conflict are hereby repealed.
